These Terms of Service ("Terms") govern your access to and use of the services provided by Iku Inc. ("iku," "we," "us," or "our") through the website ikuinc.com and any associated applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

iku is a platform that allows users ("Creators") to build AI-powered chatbots trained on their own documents using retrieval-augmented generation (RAG) technology. Creators receive a public URL where third parties ("Visitors") can interact with the AI assistant.

2. AI Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

The Service uses artificial intelligence and large language models to generate responses. By using the Service, you acknowledge and agree that:

• AI-generated responses may be inaccurate, incomplete, outdated, or misleading. The AI may produce information that appears factual but is incorrect. This is a known limitation of current AI technology, commonly referred to as “hallucination.”
• iku does not guarantee the accuracy, reliability, completeness, or suitability of any AI-generated content for any purpose.
• AI responses do not constitute professional advice of any kind, including but not limited to legal, medical, financial, tax, psychological, or engineering advice.
• You should independently verify any information provided by the AI before relying on it or making decisions based on it.
• iku is not responsible for any decisions, actions, or omissions made based on AI-generated content.
• The AI may occasionally produce responses that are irrelevant, repetitive, or inconsistent with the documents provided by the Creator.

3. No Professional Advice

Nothing provided through the Service should be interpreted as professional advice. If you need legal, medical, financial, or other professional guidance, consult a qualified professional. The AI is a tool for information retrieval, not a substitute for human expertise and judgment.

4. Creator Responsibilities

If you are a Creator, you agree that:

• You are solely responsible for the documents you upload and the content your chatbot produces based on those documents.
• You will not upload content that is illegal, defamatory, infringing on third-party intellectual property, or otherwise harmful.
• You will not use the Service to provide regulated professional advice (medical, legal, financial) without appropriate disclaimers to your Visitors.
• You are responsible for informing your Visitors that they are interacting with an AI, not a human.
• You will not use the Service to deceive, defraud, or mislead Visitors.

5. Visitor Responsibilities

If you are a Visitor interacting with a Creator’s chatbot, you agree that:

• You understand you are communicating with an artificial intelligence, not a human.
• You will not rely on AI responses as the sole basis for important decisions.
• You will not attempt to manipulate, exploit, or abuse the AI system.
• You will not input personal sensitive information (such as Social Security numbers, passwords, credit card numbers, or medical records) into the chat.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• IN NO EVENT SHALL IKU INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
• IKU’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO IKU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

7. Data and Privacy

• Creator documents are processed and stored to enable AI retrieval. Documents are associated with the Creator’s account and are not shared with other users.
• Chat conversations between Visitors and AI chatbots may be logged for analytics purposes (message counts, session data). Creators may have access to aggregated analytics.
• Visitor IP addresses may be temporarily stored for rate limiting and abuse prevention.
• We do not sell personal data to third parties.

8. Intellectual Property

• Creators retain ownership of the documents they upload.
• iku retains ownership of the Service, its underlying technology, branding, and all associated intellectual property.
• AI-generated responses are provided as output of the Service. iku does not claim ownership over AI-generated content, nor does it guarantee that such content is free from third-party intellectual property claims.

9. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the Service, other users, or third parties.

10. Service Availability

We do not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

11. Modifications

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in King County, Washington.
